After research, I found this photo be free in the US due to simultaneous publication in the US without notice and renewal. However, I also noticed that https://en.wikipedia.org/wiki/Loch_Ness_Monster#%22Surgeon's_photograph%22_(1934) claims the photographer to be Ian Wetherell, not his father Marmaduke Wetherell. Ian died in 1987, so this photo is not free until 2058.

 Keep (Disclosure: I came here from the discord server) The Berne Convention definition of a work's country of origin, which Commons uses, says "in the case of works published simultaneously [within 30 days] in several countries of the Union which grant different terms of protection, the country whose legislation grants the shortest term of protection [will be the country of origin]". The date of publication of this photograph in the UK is 21 April 1934, and I found two newspapers that published it in the US within 30 days. In the US, the term would be 1934 + 95 years, lasting until 1 January 2030 if published with a notice and renewed. In the UK, the term is 1987 + 70, expiring on 1 January 2058.
