File:Pexels-photo-1486470.jpeg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

Hi, @Levivich: Could you help me understand why this screencap would be ineligible for copyright? Absent evidence to the contrary, I would assume the author is Atlanta P.D., which would make it a State of Georgia public record and the copyright would belong to the state. Am I missing something? —Rrburke (talk) 14:58, 27 August 2020 (UTC)[reply]

Hi Rrburke, my thinking is: because it's not a creative work and doesn't meet the threshold of originality required for copyright protection. No human composed the video, selected what would be on the video, framed the shot, or made any other creative or non creative decision that went into the creation of the work. Bodycams are just fixed position surveillance cameras (which are not creative works) except the fixed position is on an officer's chest. There is some discussion of the threshold of originality and surveillance cameras at w:Threshold of originality#Pre-positioned recording devices; though I know Wikipedia is not a reliable source, the sources cited in that article are. Commons also has Category:Police bodycam footage, though that of course also isn't definitive "proof" of anything per se. What do you think? Levivich (talk) 16:54, 27 August 2020 (UTC)[reply]
